Academics ‘guest authoring’ ghostwritten studies should be charged with fraud

Academics who lend their names to medical and scientific articles ghostwritten by the pharmaceutical industry should be charged with fraud under the the Racketeer Influenced and Corrupt Organizations Act (RICO), according to two University of Toronto Faculty of Law professors.

The pharmaceutical industry often conducts research, but allows academic experts to submit it to scientific journals under their own name. Although medical professionals and academics have called for these "guest authors" to be sanctioned by journals, academic institutions and regulatory agencies, their recommendations have not been widely embraced.

"It's a prostitution of their academic standing," Professor Trudo Lemmens said. "And it undermines the integrity of the entire academic publication system."

In an article published Tuesday in PLoS Medicine, Professors Simon Stern and Trudo Lemmens argued that, "guest author's claim for credit of an article written by someone else constitutes legal fraud, and may give rise to claims that could be pursued in a class action based on the Racketeer Influenced and Corrupt Organizations Act."

"Guest authorship is a disturbing violation of academic integrity standards, which form the basis of scientific reliability," they claimed. "Pharmaceutical sponsors borrow the names of academic experts precisely because of the value and prestige attached to the presumed integrity and independence of academic researchers."

Academics who lend their names to ghostwritten studies give false respectability to claims of safety and effectiveness that threaten to undermine the integrity of medical research and patient care, according to Stern and Lemmens. This false respectability extends to the courtroom as well, when the studies are used as evidence in lawsuits to support pharmaceutical companies' claims.

"Expert witness testimony comes into court through the agency of lawyers, who are officers of the court," they explain. "When a pharmaceutical company helps to produce ghostwritten articles and its lawyers cite them in court, the lawyers are, at the very least, reckless about the falsehood and they have a duty to disclose the truth."

Pharmaceutical lawyers who to treat ghostwritten articles as legally valid evidence should be charged with "fraud on the court."

"They are often used in litigation to support the manufacturer's arguments about a drug's efficacy and safety, or to establish a record of scientific acceptance for Daubert purposes, or to credentialize an expert witness," Stern and Lemmens wrote. "Each of those uses, if attempted by a party that had helped to create the article, could risk sanction."

Congressional Job Approval Ties Historic Low of 13%

PRINCETON, NJ -- Americans' evaluation of the job Congress is doing is the worst Gallup has ever measured, with 13% approving, tying the all-time low measured in December 2010. Disapproval of Congress is at 84%, a percentage point higher than last December's previous high rating.



These results are based on an Aug. 11-14 Gallup poll, which includes the first update on Congress' job approval rating since the government reached agreement on a deal to raise the debt ceiling after contentious and protracted negotiations between President Obama and congressional leaders. Standard & Poor's subsequently downgraded the United States' credit rating, in part citing the current political environment in Washington. That sparked a week of intense volatility in the stock market, with days of sharp losses and large gains.

Frustration with Congress was evident immediately after the debt ceiling agreement, with a record-low 21% of registered voters in an Aug. 4-7 USA Today/Gallup poll saying most members of Congress deserve re-election.

President Obama's job approval rating has also declined in recent days, reaching a low of 39% in Aug. 11-13 Gallup Daily tracking.

When Gallup last measured Congress' job approval rating in early July, 18% approved and 77% disapproved. That poll came while the debt ceiling discussions were underway but well before the talks dragged on to just before the Treasury Department's Aug. 2 deadline. Continue reading here.

Another San Francisco BART protest...

 I decided to go check out the most recent BART protest yesterday, August 15th, and I was a little disappointed yet again.  I understand that our civil rights and our safety were completely ignored when BART decided to shut down all cell phone service a couple of days ago.  And I do believe we need to express our discontent, but shutting down a few BART stations and making it impossible for a lot of working, exhausted people to get home. Not a good choice.  Was a protest needed? Yes.  Were there a lot of people who just wanted to get home to their families? Yes.  Did the protest achieve anything? Maybe. Just next time, lets keep the stations open.
   






 
     One thing I would like to mention, is the amount of local news trucks on scene before any of the protesters arrived.  Is there really nothing more important to report on in this city than a couple people with masks? And the amount of policeman, who were more like riot gear robocops, was absurd.  The whole evening it seemed cops cars were speeding away from the protest to somewhere else in they city, where I am sure there was much less of a police presence.  Did they really think what happened in London was possible here in San Francisco? This is America. The land of the self consuming mind. The land where common sense is frowned upon. The land where a protest attracts more police and news trucks than actual protesters.  It's sad. I'm not saying we need violence, but it seems most people just don't care.  So either the masses are slowly waking up, or they may still be sleepwalking through life as their economic and personal freedoms are slowly being stripped away.

U.K. May Block Twitter, Blackberry in Riots

U.K. Prime Minister David Cameron said the government is considering blocking social networks and messaging services amid the worst riots since the 1980s, prompting condemnation from lawyers and free speech advocates.

The government is working with police, the intelligence services and companies to look at “whether it would be right to stop people communicating via these websites and services when we know they are plotting violence, disorder and criminality,” Cameron said today in parliament. He mentioned Research In Motion Ltd. (RIM)’s BlackBerry Messenger service as one of the tools that were used by rioters.

Police have said they are investigating the use of social- networking services such as those operated by Twitter Inc., Facebook Inc. and BlackBerry Messenger. Three people were arrested by police in Southampton, England, on suspicion of using social media and messaging to encourage rioting.

“If you try to stop people communicating, you create more of a problem,” said Jim Killock, executive director of the Open Rights Group, an organization promoting freedom of expression on the Internet. “People are angry because their freedoms are threatened.”

BlackBerry’s external U.K. spokespeople declined to comment on the possibility that authorities might shut or monitor user accounts. Twitter spokespeople could not immediately be reached.

“We look forward to meeting with the Home Secretary to explain the measures we have been taking to ensure that Facebook is a safe and positive platform for the people in the U.K. at this challenging time,” said Sophy Tobias, a spokeswoman for Facebook. “We have ensured any credible threats of violence are removed from Facebook.”

The social networking website has a policy of taking down content that threatens violence or might qualify as hate speech.

A law allowing the government to shut down a particular network could be easily abused, said David Hooper, a defamation and intellectual property lawyer with Reynolds Porter Chamberlain LLP in London. Groups could also find ways around the ban by employing other technologies, he said.

“History does show that if governments take wide powers when emotions are running very high, the powers tend to be abused,” he said.

While the U.K. government might legally be able to introduce measures to block particular messaging services or websites, the revolutions in the Middle East this year showed that the multiplicity of platforms available for communication makes governments’ actions to block it ineffective, said Rob Bratby, head of telecommunications at international law firm Olswang LLP.  Continue reading here.

UK Riots: Government Prepares Troops, Martial Law

Following numerous reports of failures on behalf of police to arrest looters or adequately respond to the riots in London that are now sweeping across the entire UK, curfews and troops on the streets are now being readied as authorities prepare to enforce martial law to quell massive civil unrest.

BBC News twice reported this morning that troops were being readied. The statement was first made by a reporter at 8:30am and then repeated by a Metropolitan Police representative who said “all options were on the table”.
U.K. Home Secretary Theresa May confirmsthat the government is considering “military support for the police”.
Curfews are also being discussed as authorities prepare to transform Britain into a locked down police state.
“Armoured vehicles have been brought in to clear the streets for the first time by police to tackle what senior officers say is the worst rioting and looting in living memory,” reports the Guardian.
“I have not heard of a curfew on mainland Britain in the past century. [It's] very difficult to impose. I’m not saying that it is definitely the way forward but it is something we have to consider,” Diane Abbott, Labour MP for Hackney North and Stoke Newington told BBC Breakfast.
Former London mayor Ken Livingstone called for police to use water cannons to disperse the rioters.
Having started in poorer areas of London, the riots have now spread to other major cities including Bristol, Nottingham, Liverpool and Manchester.
There can be little doubt that the vast majority of the rioters are products of the country’s broken society, nihilistic youths who care little about political grievances and are primarily focused with exploiting the chaos to steal as much booty as they possibly can while getting off on mindless violence. This behavior ensures the public will overwhelmingly support whatever measures are proposed to deal with them, even to the point of outright martial law.

These youths should not be seen as the vanguard of some kind of genuine revolution against an abusive system. If that were the case they would be rioting outside of Downing Street, the Houses of Parliament and Buckingham Palace. Instead they are burning down private homes and businesses while looting high-end electrical goods and clothing.
But what has exacerbated the situation is the lackluster police response, with numerous reports from the public that police stood back and allowed looters to pillage both large department stores and private small businesses for hours on end.

Media alters video, makes young boy's innocent comments appear violent, dangerous

(NaturalNews) The mainstream media's penchant for perjury has reached a new low, when local CBS affiliate in Chicago WBBM blatantly altered an interview with a young boy to make it look like he was prone to violence. After a serious shooting in his neighborhood, a four-year-old boy told reporters that he wanted to be a police officer when he was older, and have a gun in order to prevent such violence -- but WBBM edited the video to make it appear that the boy simply wanted to have a gun.

Two young people, a 16-year-old girl and an 18-year-old boy, were recently shot in a South Side Chicago neighborhood, and WBBM reported on the story. Upon explaining the details of the situation, a WBBM reporter mentions that "kids on the street as young as four were there to see it unfold," adding that they had a "disturbing reaction."

The reaction, at least as it was aired by WBBM, shows a young, four-year-old African American boy as a reporter asks him the question, "When you get older, you gonna stay away from all these guns?" The boy's answer is "No," upon which he is interrupted by the reporter with "No?!" The boy answers back "No," and the reporter then asks the boy what he wants to do when he gets older. The boy's response, as captured in the WBBM clip, is, "I'm gonna have me a gun."

The clip ends there, leaving viewers with the impression that the boy intends to be a "gangster" just like those that shot his neighbors. But in truth, the boy actually went on to explain that he plans to be apoliceofficer when he grows up, which explains why he wants a gun -- to help keep his neighborhood safe.

Greek protests turn violent as EU warns of default

    (Reuters) - Anti-austerity protests turned violent in Athens on Tuesday as the European Union warned Greek lawmakers the country faces immediate default unless they back an unpopular economic plan this week.
     Hooded youths throwing stones and wielding sticks set fire to garbage bins and a telecoms truck outside parliament and riot police fired teargas to disperse them. Trade unions began a 48-hour strike against the EU/IMF-imposed measures.
     Progress was meanwhile reported in talks to persuade European banks and insurers to voluntarily roll over maturing Greek debt as part of a planned second rescue package designed to give the euro zone country a breathing space.
     But the EU's top economic official, Olli Rehn, stressed that any further assistance for the debt-crippled nation hinged on parliament adopting a raft of spending cuts, tax rises and privatizations in crucial votes on Wednesday and Thursday.
     "The only way to avoid immediate default is for parliament to endorse the revised economic program ... They must be approved if the next tranche of financial assistance is to be released," he said in a statement.
     "To those who speculate about other options, let me say this clearly: there is no Plan B to avoid default," Rehn said, dismissing widespread reports that Brussels was working on a fallback plan to keep Greece afloat.
     The blunt alternative was underscored by Bank of England Governor Mervyn King, who told British parliamentarians that policymakers were working on ways to limit the damage from a potential default on Greece's 340 billion euro debt pile. Continue reading here.

Monsanto trying to take over world seed supply

These Monsanto chemical and GMO cronies all share genetically engineered traits and create the patented herbicides and pesticides that GMO crops require to thrive.
     Monsanto is infamous for taking advantage of small farmers, and with the advent of MoU's they are doing so with governmental license. Countries like India, Pakistan, Australia, and New Zealand have all executed MoU's with Monsanto. MoU's or memorandum's of understanding permit Monsanto to use publicly owned lands to create so called demonstration farms (GMO breeding camps) which in turn -at least in the case of Rajasthan - are subsidized by the government. Why are food prices rising so fast?

(The Economic Collapse) If you do much grocery shopping, you have probably noticed that the cost of food has been rising at a very brisk pace over the past year. So why are food prices rising so fast? According to Federal Reserve Chairman Ben Bernanke, inflation is still very low and the economy is improving. So what is going on here? When I go to the grocery store these days, there are very few things that I will buy unless they are on sale. In fact, I have noticed that many of the new "sale prices" are the old regular prices. Other items have had their packages reduced in size in order to hide the price increases. But with millions of American families just barely scraping by as it is, what is going to happen if food prices keep rising this rapidly?

The food prices are especially painful if you are trying to eat healthy. Most of the low price stuff in the grocery stores is garbage. Eating the "typical American diet" is a highway to cancer, heart disease and diabetes

But if you try to stick to food that is "healthy" or "organic" you can blow through hundreds of dollars in a heartbeat. In fact, the reality is that tens of millions of American families have now essentially been priced out of a healthy diet.

Soon there will be millions more American families that will not even be able to afford an unhealthy diet. Some recent statistics compiled by the Bureau of Labor Statistics are absolutely staggering. According to a recent CNBC article, over the past year many of the most popular foods in America have absolutely soared in price.... Coffee, for instance, is up 40 percent. Celery is 28 percent higher while butter prices rose 26.4 percent. Rounding out the top five are bacon, at 23.5 percent, and cabbage, at 23.3 percent.

Peru implements ban on GMOs

(NaturalNews) A rarity in the world today, the South American nation of Peru has yet to be contaminated by the import, cultivation, or breeding of any genetically-modified (GM) crops -- at least not openly -- unlike some of its nearby neighbors like Brazil that have openly and willingly accepted them. And the recent decision by Peru's Plenary Session of the Congress to enact a ten-year moratorium on GMOs, in direct defiance to previous governmental pushes for legalization, represents a huge victory for Peruvians.
     Even though a recent test conducted by the Peruvian Association of Consumers and Users (ASPEC), a non-profit organization that promotes and defends the rights of Peruvian consumers, revealed the presence of GM contaminants in about 77 percent of supermarket products it tested, at least the country itself will not be contributing to the spread of GM pollution around the world.
     Anibal Huerta, President of Peru's Agrarian Commission, stated that the ban was necessary to prevent the "danger that can arise from the use of biotechnology." At least someone in a position of governmental authority is willing to admit the truth about GMOs, mainly that they contaminate the food supply with untested "Franken-genes," put an immense chemical burden on the environment, and are implicated in a wide variety of disorders and illnesses (http://www.naturalnews.com/GMO.html).
     He and the many other congressmen who supported the moratorium also cited agricultural biodiversity as another reason why GMOs needed to be banned. Biotech crops, of course, are responsible for replacing formerly diverse, self-sustaining agricultural systems with endless fields of GM crops like corn and soybeans.
     "There is an increasing consensus among consumers that they want safe, local, organic fresh food and that they want the environment and wildlife to be protected," wrote Walter Pengue from the University of Buenos Aires in Argentina, in a recent statement concerning GMOs in South America. "South American countries must proceed with a broader evaluation of their original agricultural policies and practices using the precautionary principle."

Right now, the worst nuclear disaster in human history continues to unfold in Japan , U.S. nuclear facilities are being threatened by flood waters, the U.S. military is bombing Yemen, gigantic cracks in the earth are appearing all over the globe and the largest wildfire in Arizona history is causing immense devastation.  But Anthony Weiner, Bristol Palin and Miss USA are what the mainstream media want to tell us about and most Americans are buying it.
     In times like these, it is more important than ever to think for ourselves.  The corporate-owned mainstream media is not interested in looking out for us.  Rather, they are going to tell us whatever fits with the agenda that their owners are pushing.
     That is why more Americans than ever are turning to the alternative media.  Americans are hungry for the truth, and they know that the amount of truth that they get from the mainstream media continues to decline.
The following are 12 things that the mainstream media is being strangely quiet about right now....

#1 The crisis at the Fort Calhoun nuclear facility in Nebraska has received almost no attention in the national mainstream media.
     Back on June 7th, there was a fire at Fort Calhoun.  The official story is that the fire was in an electrical switchgear room at the plant.  The facility lost power to a pump that cools the spent fuel pool for approximately 90 minutes.  According to the Omaha Public Power District, the fire was quickly extinguished and no radioactive material was released.
     The following sequence of events is directly from the Omaha Public Power District website....
  • There was no such imminent danger with the Fort Calhoun Station spent-fuel pool.
  • Due to a fire in an electrical switchgear room at FCS on the morning of June 7, the plant temporarily lost power to a pump that cools the spent-fuel pool.
  • The fire-suppression system in that switchgear room operated as designed, extinguishing the fire quickly.
  • FCS plant operators switched the spent-fuel pool cooling system to an installed backup pump about 90 minutes after the loss of power.
  • During the interruption of cooling, temperature of the pool increased a few degrees, but the pool was never in danger of boiling.
  • Due to this situation, FCS declared an Alert at about 9:40 a.m. on June 7.
  • An alert is the second-least-serious of four emergency classifications established by the Nuclear Regulatory Commission.
  • At about 1:15 p.m. on June 7, FCS operators declared they had taken all appropriate measures to safely return to the previously declared Notification of Unusual Event emergency classification. (See first item above.)
     But the crisis at Fort Calhoun is not over.  Right now, the nuclear facility at Fort Calhoun is essentially an island. It is surrounded by rising flood waters from the Missouri River.
     Officials claim that there is no danger and that they are prepared for the river to rise another ten feet.
The Cooper Nuclear Station in Brownville, Nebraska is also being threatened by rising flood waters.  A "Notification of Unusual Event" was declared at Cooper Nuclear Station this morning at 4:02.  This notification was issued because the Missouri River's water level reached 42.5 feet.
     Right now the facility is operating normally and officials don't expect a crisis. But considering what has been going on at Fukushima, it would be nice if we could have gotten a lot more coverage of these events by the mainstream media. Continue reading here.

Illinois school turned into "Lockdown High"

     It was Friday the 13th, and Skylar Walters thought he was going to die.   The 16-year-old inmate of Orangeville Jr.-Sr. High in Illinois was in gym class when a deranged-looking man barged into the school and began firing what appeared to be a handgun at several of the other students.  "I started praying to God and saying my last words," Skylar later recalled. "I was scared. I didn't know what to do."
     As the intruder fired his gun, he called out the name of a particular student; the youngster quite sensibly fled the building. Other kids "were just running everywhere and crying and hiding," Skylar recounted. Some of the panicking schoolkids probably attempted to call or text their parents to describe the horror unfolding in front of them. They didn't know that each of the parents had been instructed not to answer if his child issued a desperate plea for help. 
     That last sadistic touch is what distinguished the May 13 "active shooter drill" in Orangeville from countless other performances of its kind staged in schools across the Soyuz by the Police State Play Actors' Guild. Most of the time, the kids for whose supposed benefit those drills are choreographed -- and the parents responsible for their care, education, and upbringing -- are let in on the joke.
     Last October 10, for example, a mob of "between 80 and 100 officials" from law enforcement agencies staged a little Garrison State melodrama in New York's William H. Protests in Greece Turn Violent

   Stone-throwing Greeks clashed with police and tens of thousands of protesters marched on parliament on Wednesday to oppose government efforts to pass new austerity measures for the debt-stricken euro zone state. Unions representing half the five-million-strong workforce also launched a nationwide strike, shutting ports, schools and other basic services in the Mediterranean state. Minister George Papandreou must push through a new five-year campaign of tax hikes, spending cuts and sell-offs of state property to continue receiving aid from the European Union and International Monetary Fund and avoid default.

Bill Gates pushes for 90 percent vaccination rate worldwide

     (NaturalNews) The infamous Bill Gates is on a crusade to vaccinate the entire world.      Among his many speeches, however, Gates has given conflicting information concerning the agenda behind his vaccination push. In his most recent speech, he claims vaccines will save lives.
